I cancelled my direct debit after being a member for 4 years. It had been so long that I didn't even have the contract anymore. I received a call from Fitness First in Godalming saying that I need to pay for the month even though (a) I cancelled my direct debit 2 weeks before the start of the month and (b) I haven't entered the gym this month. This is disgusting robbery, especially since it is very easy to simply cancel a member's card as soon as their direct debit doesn't go through. This is clearly just a money-making scheme.

If you sign into a 12 month contract then why would you not honor it, if you have no intention of sticking to it then don't sign it! Read your terms and conditions, plus your clearly told that you must give 1 calender month for cancellation request. Its not as simple as "very easy to simply cancel a member's card". You are whats wrong with British society, no honesty or intergrity.

There are two methods of cancelling your contract. Both requires 1 month notice. e.g. you signed a 3 month contract, so you would give notice on month 2.

1. schedule a meeting with your home club manager to fill in the cancellation forms. Refuse to give any reason as to why you're cancelling so s/he has no grounds to 'convince' you to stay. Record the meeting using your mobile phone while you're at it 'just to be safe'. The cancellation form needs his/her signature.

2. this is the much easier method.

Post a recorded letter (includes date you joined, how long contract is for, how much you will have paid Fitness First altogether throughout the contract period, your contact details, membership number, home club address).

That's it. Fitness First does NOT have to even RECEIVE the recorded letter you posted for it to take legal effect. Remember to post it, do not hand the letter to the receptionist/manager in person or the postal rule will not apply.

After your contract ends, cancel your direct debit and change your debit card. If Fitness First still somehow manages to steal your money then send them a letter or make a phone call (use phone recorder and inform them the call is being recorded) stating they are to refund you otherwise you will sue for the money back with interest, and sue for emotional stress caused from harrassment.
